What Survey Do I Need?
The type of asbestos survey you need depends on how the building will be used.
If the property is occupied and no major works are planned, a Management Survey is usually required. If you are planning refurbishment, alterations or demolition, a Refurbishment Survey is essential. Targeted testing can also be used where specific materials are suspected to contain asbestos. If you’re unsure, we’re happy to advise on the most appropriate survey for your situation.


Legal Requirements
Under the Control of Asbestos Regulations 2012, dutyholders are legally required to identify, manage and control asbestos in non-domestic properties. This includes commissioning appropriate asbestos surveys, keeping records of asbestos-containing materials and ensuring they are not disturbed or pose a risk to occupants or contractors.
Failure to comply with these regulations can result in serious health risks, enforcement action and legal penalties. Professional asbestos surveys and management plans are essential to meeting these legal obligations.
Management Survey
An Asbestos Management Survey is designed to locate and assess any asbestos-containing materials that could be disturbed during normal occupation, maintenance or repair works.
The survey identifies the presence, condition and risk level of asbestos, helping property owners meet their legal duty to manage asbestos safely. This type of survey is suitable for residential, commercial and public buildings that are in normal use.


Management Plan
An Asbestos Management Plan sets out how identified asbestos-containing materials will be safely managed within a property. It includes information on the location and condition of asbestos, recommended control measures and procedures to prevent disturbance.
A management plan is a legal requirement for non-domestic properties and is essential for protecting occupants, contractors and anyone working on the building. A management survey must be completed first in order to complete a management plan.
Refurbishment Survey
An Asbestos Refurbishment Survey is required before any refurbishment, alteration or intrusive works are carried out.
This fully intrusive survey is designed to locate all asbestos-containing materials within the area of works, including those hidden within the building structure. The survey ensures asbestos risks are identified and managed before work begins, helping to prevent exposure and costly delays.


Targeted Testing
Targeted asbestos testing is ideal when there is concern about specific materials or areas within a property.
Samples are taken from suspected materials and analysed to confirm the presence or absence of asbestos.
This service is often used prior to minor works, maintenance tasks or for reassurance where asbestos is suspected but a full survey is not required.
About Asbestos
Asbestos still kills around 5000 workers yearly, more than the number of people who die on the roads. Approximately 20 tradesmen die each week due to past exposure. However, asbestos isn't just a problem of the past. It can be present today in any building built or refurbished before 2000.
Fibres are released into the air when materials that contain asbestos are disturbed or damaged. When these fibres are inhaled, they can cause serious diseases. These diseases will not affect you immediately. They often take a long time to develop, but it is often too late to do anything once diagnosed. This is why you must protect yourself now.

Legislation
The Control of Asbestos Regulations 2006 (CAR 2006), and more specifically, Regulation 4: ‘Duty to manage asbestos in non-domestic properties’ sets a legal requirement for owners and occupiers of non-domestic buildings to have an Asbestos Survey and up-to-date Asbestos Register in place.
The Control of Asbestos Regulations 2012 came into force on 6 April 2012, updating previous asbestos regulations to reflect the European Commission’s view that the UK had not fully implemented the EU Directive on exposure to asbestos (Directive 2009/148/EC).

The Control of Asbestos Regulations 2012 place an absolute legal “Duty to Manage” asbestos in non-domestic premises. Coventry Property Surveys can assist with this by providing the relevant surveys for your needs, and we also offer assistance with developing Asbestos Management Plans.

In addition to criminal, civil, and HSE sanctions for non-compliance, property transactions are often delayed because the owner and/or occupier have failed to have an assessment carried out to comply with the law and must address this before proceeding with a sale or letting of premises.
Failure to comply with the regulations can result in both criminal and civil liability, including a fine of up to £20,000 per offence.
